CHAPTER XII. PUBLIC PROPERTYCHAPTER XII. PUBLIC PROPERTY\Article 8. General Regulations

As used in this article, the following terms have these prescribed meanings:

(a)   Firearm” shall mean any handgun, pistol, or revolver.

(b)   “Public Property” shall mean any property, building, street, alley, roadway, right-of-way, sidewalk, park, or any other property deemed to be under the ownership of the City of Osawatomie.

(c)   “Properly marked and secured” shall mean signage and security measures in compliance with K.S.A. 75-7c20 as said provisions now apply or may hereafter be amended.

The City of Osawatomie, Kansas, hereby prohibits openly carrying or the carrying of any concealed firearm by any person other than those identified in this article while in the indoor premises and buildings of any properly marked city-owned or leased buildings, including park buildings and shelters, lake buildings and shelters, or other city-owned buildings on recreational areas within the City of Osawatomie, Kansas.

Violation of 12-802 is a Class B violation.

(a)   The prohibitions set forth in 12-802 above shall apply to the interiors of the structures on all such properties; provided, however, that the prohibitions shall not apply to persons who are otherwise lawfully in possession of any such firearm while in a motor vehicle which is located in an area designated for public vehicular traffic or for public vehicular parking.

(b)   The prohibitions set forth in 12-802 above shall not apply to any person identified under the exclusions set forth in:

(1)   subsections (b) or (c) of K.S.A. 21-4201 regarding the criminal use of weapons, as said provisions now apply or may hereafter be amended; or

(2)   K.S.A. 75-7c20, as said provisions now apply or may hereafter be amended.

No refuse, waste or excrement of any kind or character shall be thrown or deposited on any public property except in receptacles provided for such purpose.
